Terms of Service

The agreement between you and Sunsetcrew when you join or take part.

The important bits, up front

Welcome to Sunsetcrew. These Terms of Service ("Terms") govern your access to and use of all Sunsetcrew services, including community-organised events, online and in-person meetups, digital community spaces (such as WhatsApp), and our website and payment platforms (collectively, the "Services").

By accessing or using Sunsetcrew's Services including by agreeing to these Terms of Service at checkout you agree to be bound by these Terms and by our Code of Conduct, which forms part of this agreement. If you do not agree to both, please do not access or use our Services.

Clause 1

Who we are

Sunsetcrew is a Gold Coast based community dedicated to facilitating meaningful connection through inclusive social events. Our Services are operated from Queensland, Australia and are subject to Queensland and Australian law.

Sunsetcrew is operated by KJK Ventures Pty Ltd.

Please read this before you take part

Many Sunsetcrew events are community-led or volunteer-hosted. Sunsetcrew staff do not supervise all events, cannot monitor all participant conduct, and are not responsible for the actions or omissions of participants, volunteers, or third parties. Please read the Limitation of Liability section (Clause 3) carefully.

What you are agreeing to

By accessing or using the Services, you confirm that:

If you do not agree to these Terms, you must not access or use the Services or participate in any Sunsetcrew event.

Clause 3

Limitation of liability & assumption of risk

You take part at your own risk

You attend and participate in all Sunsetcrew events and activities voluntarily and at your own risk. You are responsible for assessing your own physical ability, health, and wellbeing before taking part in any activity. Sunsetcrew is not responsible for making that assessment for you.

General limitation

To the extent permitted under Queensland law and the Australian Consumer Law (ACL), Sunsetcrew is not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of opportunity, reputation, or data arising out of your participation in any Sunsetcrew event.

To the extent permitted by law, Sunsetcrew is not liable for personal injury, illness, property damage, or loss arising from participation in any activity, except where such injury or damage is caused by our proven negligence.

Recreational services (s 139A CCA)

Under section 139A of the Competition and Consumer Act 2010 (Cth), to the extent the services provided by Sunsetcrew are "recreational services", Sunsetcrew excludes liability for death, personal injury, and the aggravation, acceleration, or recurrence of a physical or mental injury, arising from the supply of recreational services, except where the injury or death results from Sunsetcrew's reckless conduct.

By participating in Sunsetcrew activities that may be classified as recreational services (including but not limited to outdoor gatherings, games, walks, sports, hikes, beach activities, or social meetups), you acknowledge and accept the risks associated with those activities and agree to participate voluntarily. If you do not agree, you must not participate in activities that may constitute recreational services.

Community-led and member-suggested events

Many Sunsetcrew events are community-led, informal, or volunteer-organised, and some activities are suggested or organised by members themselves (for example, through our member-led events space). These may not be planned, attended, or supervised by Sunsetcrew staff.

Unless the loss is caused by Sunsetcrew's proven negligence, Sunsetcrew is not responsible for:

A member suggesting or organising an activity does so in their personal capacity, not on behalf of Sunsetcrew.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Clause 4

Subscriptions, payments & cancellation

Sunsetcrew membership requires a paid subscription processed via Stripe. We do not accept any other form of payment for membership.

How billing works

You agree to this recurring charge when you join. The trial price and the ongoing renewal price are also shown to you on the checkout page at the time you pay.

How to cancel the official way

You can cancel your membership yourself, at any time, using the official cancellation page:

Use the email address you signed up with at checkout. This link is the only official way to cancel. Messages sent by Instagram, other social media, email, or to individual team members are not a valid cancellation and will not stop your renewal.

Messaging Sunsetcrew does not automatically cancel your membership. Leaving the WhatsApp community does not automatically cancel your membership. The only way to cancel is through the official cancellation link above.

Once your cancellation is processed, you will receive an email confirming it. If you don't receive that confirmation, your membership has not been cancelled please try again or contact us.

Cancelling in time

To avoid being charged for the coming period, you must cancel at least 48 hours before your subscription is due to renew. If you cancel less than 48 hours before renewal, the upcoming charge may still apply, and your membership will then end at the close of that period.

If something goes wrong, tell us before you renew

If you have any issue with your membership, billing, or cancellation, you must reach out to our team before your renewal date so we can help. If you do not reach out before renewing, we will reasonably assume you are choosing to stay in the community, and the renewal will proceed as normal.

Refunds

We do not offer change-of-mind refunds. Membership renews automatically on a clear, disclosed schedule. If you are charged for a renewal because you did not cancel in time, that charge stands it is your responsibility to cancel before renewal using the official link above.

This does not affect your rights under the Australian Consumer Law. Specifically:

Ticketed events

From time to time, Sunsetcrew may offer additional ticketed events that are purchased separately from your membership.

This does not affect your rights under the Australian Consumer Law. If a ticketed event is cancelled by Sunsetcrew, or is not provided as described, you remain entitled to the remedies guaranteed under the ACL.

Clause 5

Community expectations

We are committed to creating a safe and inclusive space for all. These Terms work alongside our Code of Conduct, which sets out in full how we expect members to treat one another and what happens when someone crosses the line. You agree:

Sunsetcrew reserves the right to remove members who violate these expectations or our Code of Conduct, at our discretion. Where a member is removed for a serious breach of our Code of Conduct, their membership may be cancelled without refund.

Clause 6

Your consumer rights

Under the Australian Consumer Law (ACL), you are entitled to guarantees that cannot be excluded. This means you have a right to:

Clause 7

Privacy

We only collect the personal data necessary to provide you with our Services. This includes, but is not limited to, your name, email address, phone number, payment details, and communications (such as direct messages and form responses). For more information, please see our Privacy Policy.

Clause 8

Media & promotional content

We love capturing the energy and connection of our events to share with the wider community.

By attending a Sunsetcrew event, you acknowledge and consent to being photographed or filmed. This media may be used for promotional purposes, including on our website, social media, or other platforms that celebrate our community.

While we may film or record parts of our events, personal conversations and participant sharing are never published publicly without your clear, prior consent. Any group footage that includes sensitive audio will be covered with music or ambient sound to protect your privacy before being posted.

Clause 9

Changes to these Terms

We may update these Terms to reflect changes in law, our Services, or community practices. We'll notify you of significant updates via the Sunsetcrew WhatsApp community. By continuing to use our Services after changes come into effect, you agree to the updated Terms. If you do not wish to accept the updated Terms, please cancel your membership using the official link in Clause 4.
